Who is Maxpanda?

We are a SaaS software company that provides state of the art maintenance software to maintenance professionals. We do this by allowing maintenance professionals to create an account on our server which then creates for them their own Maxpanda instance. In the instance they can fully operate their maintenance operations.

Sources of Personal Information

Maxpanda is both a controller and processor of information. This means for some information we decide how to use personal information in the context of a service we provide. In other cases we use the personal information as instructed by the licensor/licensee of products becoming a processor.

The data we learn from customers helps us personalize and continually improve our services to better assist you. We collect personal information about you from your interactions with us and from certain third parties and other sources (such as your employer who is accessing our Services or from publicly available sources where permissible).

It is necessary for performance of the Maxpanda application. In this case personal information is processed to provide you with our Services. You give us your consent. Who Will the Data Be Shared With? Maxpanda does not sell or share information to outside sources. Your information will only be shared with your employer. Your personal information will stay with Maxpanda, your employer and third party service providers. Third parties include those who deliver services or act on our behalf, law enforcement or agencies, parties participating in Maxpanda’s services and parties who protect our rights and systems (legal counsel and information security professionals). Third party service providers are never allowed to share or use personal information made available to them for any purpose other than to provide services for us.

Our information security procedures and policies align with international standards and are reviewed regularly in order to meet the sensitivity nature of the personal information, software and technology we handle.

How Long Do We Keep Data?

Our data retention schedule for personal information is based on the following criteria:

  1. Length of time necessary to fulfill our business obligations in order to demonstrate we have fulfilled our obligations.

Your Rights and Consent Maxpanda complies with the General Data Protection Regulation (GDPR) of Europe as well as other privacy laws. These laws give you the right to request, restrict, rectify and erase your personal information. Under these laws your affirmative consent is necessary for the collection and processing of your data. The following is a list of rights you have under the GDPR:

Subject Access Request: You have the right to ask us to confirm what personal data we hold in relation to you. We will provide you with the information requested within one month free of charge. Data portability: You have a right, in certain circumstances, to be given a copy of your personal data in a machine readable format to facilitate a transfer of the data to another organization. Right to be forgotten: You have the general right to have your data erased. The right is restrictive and gives right to erasure when the data is out out of date or processed on the basis of consent which has since been withdrawn.

Right to Rectification: You have a right to have inaccurate information about you corrected or removed. Right to Restriction of Processing: You have the right to have personal information about you used only for restricted purposes. Right to withdraw consent: You have the right to withdraw your consent to the processing and storage of your personal information at any time. Withdrawal of consent will not affect the lawfulness of our use of your personal information prior to your withdrawal.

Your consent must be freely given, specific, informed and unambiguous in order to comply with legal standards. Your statements or clear affirmative action signifies your agreement to the processing of your personal and business data.

Data Breach

In the unlikely event Maxpanda learns of a suspected or actual personal data breach, IT Security will perform an internal investigation and take appropriate remedial measures in a timely manner, according to the Data Breach Policy. Where there is any risk to the rights and freedoms of data subjects, Maxpanda will notify the relevant data protection authorities without undue delay and, when possible, within 72 hours.

EU-US Privacy Shield

Maxpanda complies with both the EU-US Privacy Shield Framework and the Swiss-US Privacy Shield Framework, as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries and Switzerland to the United States. If there is any conflict between the policies in this Privacy Policy and the Privacy Shield Principles, the Privacy Shield Principles will govern. GoMAX Mobile App

GoMAX app collects location data to enable the displaying of STAFF/VENDOR/ASSET work order location using user's mobile GPS and/or physical LOCATION ADDRESS if entered by the Company Admin. This feature is set to the OFF setting by default and may be turned on by the user within the mobile system menu. GPS/ADDRESS location services will collect data even when the app is closed in the background or not in use, until it is switched off by you. Location data collected is only utilized to display markers on live HERE map functionality. Location data is only visible to Company Admins and Editors within their own Maxpanda CMMS account. This data is not shared with any 3rd party or other application and is deemed private.

How Maxpanda uses User location information (Android)

You'll see a request prompted by your device for permission to share your location information when you login to Maxpanda's GoMAX mobile app, which includes location data collected via gps. As a default, for the best service available the app asks you to turn on location services "Allow only while using the app." We use location data to allow you to create a GPS location work order to assist the approval of such work orders by your supervisors, editor or admin.

If you're using an Android device, you have 3 location settings to choose from:

Allow all the time: We may collect location information at any time, even when you're not actively using the GoMAX app. If a service needs "Allow all the time" we'll ask for your permission when you enable the service.

Allow only while using the app: We may collect location information when the app is visible on your screen. You'll get a persistent notification in your Android notification panel if location is being collected in the background when you are in the "While using the app" setting.

Deny: This option disables location services for the GoMAX app. You can still use the app, but you'll only be able to submit work orders at a location predefined in your company admin's database.

You can always manage your location settings in your device's location preferences.

Sharing your GPS locations

Under no circumstances do we share your location information with any 3rd party. We treat your location information with the strictest measures possible and in accordance with our Privacy Notice. Review GoMAX mobile location service in this short video.
